Terms and Conditions

1. Exclusive Photographer

It is understood that Emma Billson Photography (hereafter referred to as the “Studio” or “Photographer”) is the exclusive official photographer retained to perform the photographic services requested under this Contract.


2. Payment

A non-refundable deposit is due at the time of booking to reserve the chosen date and time. The remaining balance is due no later than 7 days before the photoshoot date.

No part of any order, including previews, will be delivered until the balance is paid in full. Clients assume responsibility for all legal or collection fees incurred in the event of payment default.

Emma Billson Photography accepts payment by cash or bank transfer. Bank details will be provided at the time of booking.


3. Pricing

The charges in this Contract are based on the Studio’s standard price list. This price list may be updated periodically, and future orders shall be charged at the prices in effect at the time the order is placed.


4. Cancellations

Upon signing, the Photographer reserves the agreed time and date. Unless the Studio is able to fully replace the cancelled booking, all session fees and retainers are non-refundable, even if the session is rescheduled or cancelled for any reason other than inclement weather.


5. Postponements

If, in the Photographer’s opinion, inclement weather or other adverse conditions prevent the creation of images meeting the Studio’s artistic standards, the Photographer may reschedule the session or suggest an alternate location.


6. Limit of Liability

In the unlikely event that the Photographer cannot fulfil this Contract due to fire, casualty, illness, act of God, or any cause beyond the Photographer’s control, all payments (excluding services already provided) will be refunded, and no further liability shall be held.

This limitation also applies to loss or damage of photographic materials due to technical malfunction, postal loss, or accidental damage. In no case shall the Photographer’s liability exceed the amount paid under this Contract.

Nothing in these Terms shall limit or exclude the Photographer’s liability for death or personal injury caused by negligence, or for any matter for which liability cannot legally be excluded.


7. Model Release & Use of Images

Emma Billson Photography may use images from the session for portfolio, website, social media, and promotional materials unless the Client explicitly opts out.

Clients who do not wish for their images to be used in this way must notify the Photographer in writing (via email or on the provided booking form) before the session or gallery delivery. Consent may be withdrawn at any time with written notice.

For sessions involving children under 18, consent must be provided by a parent or legal guardian.


8. Copyright and Usage

The copyright of all photographs remains with Emma Billson Photography at all times. Clients are granted a personal licence to print and share the images for non-commercial use only.

Commercial use (e.g., for brand or advertising purposes) requires written permission and may be subject to a separate licensing agreement. Images may not be altered, filtered, or edited in a way that misrepresents the Photographer’s work or brand.


9. Social Media

This clause applies to platforms including (but not limited to) Facebook, Instagram, and blogs. When sharing online, clients agree to credit Emma Billson Photography. Clients may not edit or filter the Photographer’s images, except for platform-required cropping.

The Client agrees to take responsibility for family or friends who share the images online and ensures they also follow these terms.


10. Substitutions

In the event of illness or unavoidable scheduling conflict, the Studio may substitute another qualified photographer to fulfil this Contract. The replacement will be a competent professional vetted by Emma Billson Photography.


11. Data Protection

Emma Billson Photography stores and processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Client data will only be used to provide photographic services and, where consent is given, for marketing.

Clients have the right to access, correct, or request deletion of their personal data at any time by contacting the Photographer in writing.


12. Studio Conduct, Safety & Supervision

Clients acknowledge that sessions take place within a working photography studio located in the Photographer’s home.

For safety reasons, children must remain under the direct supervision of a parent or guardian at all times. Parents/guardians are responsible for ensuring that children do not run, climb, open closed doors, or enter areas of the home outside the designated studio space.

Pets are welcome by prior arrangement only and must be kept under control at all times.

The Photographer is not responsible for accidents or injuries that occur due to lack of supervision or failure to follow studio guidance.

Clients will be held responsible for any damage to studio equipment, props, or furnishings caused by unsupervised children, pets, or guests.

The Photographer reserves the right to pause or stop a session if behaviour poses a risk to safety, studio property, or the wellbeing of those present.


13. Modifications, Governing Law & Severability

This Contract may only be modified in writing and signed by both parties.

If any provision of this Contract is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
